The Fair Employment and Housing Commission (FEHC) contains regulations requiring sexual harassment training for all businesses or contractors with 50+ employees. Specifically, under AB 1825, organizational supervisors are required to receive two hours of sexual harassment training every two years, or within 6 months of employment or promotion to a supervisory position. The deadline for completing the first sexual harassment training was December 31, 2005. New businesses must provide training within 6 months. Businesses that expand to 50 employees have 6 months to complete the training.
Although not required by law, businesses with less than 50 employees can still benefit from the protection sexual harassment training provides. Providing sexual harassment training offers organizations an affirmative defense in the event an employee files a sexual harassment lawsuit.
In the recent revisions to AB 1825, the FEHC has clarified who can provide sexual harassment training and the specific content to be covered in training. These revisions to AB 1825 include:
- Training to be conducted by a qualified trainer;
- A minimum of two hours of interactive training;
- All 11 points of government-mandated content covered;
- All training is required to include assessments of learning objectives, hypothetical scenarios, and participant-engaged discussions;
- Documentation of training, must be on file for a minimum of two years.
